Also, the Act only applies to law within the jurisdiction of the federal government. Thus the Act applies to federally enacted courts (i.e. Supreme Court, courts of Appeal, Superior Courts, and Federal Courts), criminal trials, federal administrative trials (e.g. Canadian Human Rights Commission or Gomery Commission ), bankruptcy, and other areas of law under the federal government.

Rules of evidence for civil trials are dictated by provincial Evidence Acts.
