A Special Election may be held in the 22nd Congressional District Of Texas to choose a new member of the United States House Of Representatives to replace Tom DeLay , who announced his resignation on April 3 2006 . His resignation is not yet effective, and is expected in May or June 2006. Governor Rick Perry has stated that he will not call a special election before the general election on 7 November 2006 , as the only uniform election date between DeLay's resignation announcement and the November general election is on 13 May , which will not fall within 20 days after DeLay's resignation takes effect. The governor is empowered to call an emergency special election on a day that does not coincide with a uniform election date, but has stated an unwillingness to do so. Two scenarios are possible within the Governor's framework: the governor can leave the seat vacant until the next Congress or a special election can be held on the same ballot as the general election, filling out the remaining two months of DeLay's term. This, however, would have the effect of voters choosing twice for the same seat in the same election, and in a special election, the victor must receive a majority to win outright or face a runoff in December, while this is not the case for a general election. This could lead to one person being elected to Congress for two months (or one) and a different one elected to take office in January with the rest of Congress for an entire term.
