Is there such a thing as a Citizen who does not abide a society's laws? Essentially some western thought proposes that a criminal has placed him/her self outside of law and civilization. i.e. He/she is a terrorist, freedom fighter, criminal, anarchist, or some other category of Sovereign with self evidently inalienable rights answerable only to God or the universe who contests with the other established forces or organizations seeking to encourage specific behavior consistent with their own perceived interests or policies. A problem with this view is .... who gets to define the laws and mediate or mandate resolutions when definitions and cultural context or inexperience lead to mistakes? An intellectually dishonest person will routinely resort to misinformation, lies and obfuscations to avoid societies penalities for criminal behavior. How long can members of a society or community endure the often ghastly consequences before they begin to resort to the apparently successful criminal behavior? An argument might be constructed that the criminal has no responsibility to comply with instruction, regulation, law, license, planning mandated by society. If just government derives its powers from the consent of the governed then clearly a government has inherent sovereignty over a person it alleges has opted out of society by breaking the laws of that society unless they have previously agreed to abide by those laws. |
