''"Fruit from a forbidden tree"'' is an informal Legal term exclusive to the United States Justice System , used to refer to illegally gained Evidence . All evidence found to be of such nature is disregarded in a court of law. The phrase itself is an allusion to the religious story of Adam And Eve . Because of the existence of the Fourth Amendment in the Bill Of Rights , those in the fields of law investigation and enforcement must also obey the law, and may not break the law to further investigate a crime. They may only perform a search for evidence if they have a Search Warrant , or have Probable Cause to believe that a search is necessary and must be performed immediately (or before the time it would take to acquire a search warrant). Evidence which has been obtained without legal means is colloquially referred to as "Fruit from a forbidden tree". If evidence is found to have been obtained illegally, it is inadmisable in court. |
