The first Earl of Annandale and Hartfell 's (second and third creations) successor, William, was made ''Marquess of Annandale''. At the death of the third Marquess , no-one could prove a claim to the titles. The earldom stayed dormant until Patrick Hope-Johnstone's claim was approved by the House Of Lords in 1985. The Committee for Privileges ruled that the creation of 1661 became extinct with the death of the third marquess but that Charles II's 1662 charter of regrant of lands constituted the creation of a new title. The creation of 1661 was to 'heirs male' the creation of 1662 to 'heirs male...all of which failing the nearest heirs whatsoever'. The 1662 creation therefore descended through the female line and the closest heir was Patrick Hope-Johnstone.
