The appeal court upheld the core finding of the previous case, that the identities should not be revealed to the plaintiffs, while modifying the test required in this kind of case and also saying that, given the preliminary stage of the proceedings, the lower court should not have commented on whether the alleged filesharing was actually copyright infringement. Judgment was delivered 19 May 2005 .

The renowned ''Canadian Internet Policy and Public Interest Clinic'', CIPPIC , appeared as an intervener in the case and played a key role in arguments presented to each level of court.
